Welcome to Torny! We’re excited to have you as a user of our lawn bowls training and analytics iOS application. Before you get started, please take a moment to read through our Terms and Conditions outlined below.
By downloading, installing, or using the Torny app, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not download or use the Torny app.
1.1. Torny is a mobile application available exclusively on iOS devices that provides lawn bowls training tools, performance analytics, and progress tracking features.
1.2. The app allows users to record training sessions, track shot accuracy, measure performance metrics, and analyse improvement over time.
1.3. Torny is designed for lawn bowls players of all skill levels who want to improve their game through data-driven training insights.
2.1. You must be at least 13 years old to use Torny. Users under 18 should have parental consent.
2.2. You are responsible for maintaining the confidentiality of your account credentials and ensuring their proper use. Any activity on your account is your responsibility.
2.3. You may create only one account per person and must provide accurate information during registration.
2.4. Founding members who register during the launch period will receive lifetime access to premium features at no cost.
3.1. You agree to use Torny only for lawful purposes related to lawn bowls training and performance tracking.
3.2. You may not attempt to reverse engineer, decompile, or disassemble the app.
3.3. You may not use automated systems, bots, or scripts to interact with the app.
3.4. You agree not to interfere with the proper functioning of the app or attempt to gain unauthorized access to any part of our systems.
4.1. Torny collects training data, performance metrics, and usage information as described in our Privacy Policy.
4.2. All personal data is handled in accordance with applicable privacy laws and our Privacy Policy.
4.3. Training data belongs to you, and you may request deletion of your data at any time.
4.4. We may use aggregated and anonymized data for app improvement and statistical purposes.
5.1. Your use of Torny is also subject to Apple’s Terms of Service and App Store Review Guidelines.
5.2. Apple is not responsible for the app or its content, and any claims should be directed to Torny Limited.
5.3. In case of conflict between these terms and Apple’s terms, Apple’s terms shall prevail regarding app distribution and usage.
5.4. Apple and its subsidiaries are third-party beneficiaries of these terms and have the right to enforce them.
6.1. Founding members receive lifetime access to all premium features at no cost.
6.2. Future subscription plans may be introduced for new users after the founding member period.
6.3. Any future subscription fees will be processed through the Apple App Store using your iTunes account.
6.4. Subscription management and cancellations must be done through your Apple ID account settings.
7.1. All content, software, and materials in the Torny app are owned by Torny Limited or its licensors.
7.2. You may not copy, modify, distribute, or reproduce any part of the app without explicit written consent.
7.3. The Torny name, logo, and branding are trademarks of Torny Limited.
8.1. Torny is provided “as is” without warranties of any kind, express or implied.
8.2. We do not guarantee that the app will be error-free, secure, or uninterrupted.
8.3. Training recommendations and analytics are for informational purposes only and do not replace professional coaching.
9.1. Torny Limited shall not be liable for any direct, indirect, incidental, or consequential damages arising from app usage.
9.2. Our total liability shall not exceed the amount paid by you for the app (if any) in the twelve months preceding the claim.
9.3. We are not responsible for injuries that may occur during training or while using the app.
10.1. We may update the app through the Apple App Store to add features, fix bugs, or improve performance.
10.2. We reserve the right to modify or discontinue features with reasonable notice to users.
10.3. Continued use of the app after updates constitutes acceptance of any changes.
11.1. You may delete your account at any time through the app settings.
11.2. We may suspend or terminate accounts for violations of these terms or for other legitimate reasons.
11.3. Upon termination, your access to the app and its features will cease, but founding member status cannot be revoked for terms violations alone.
12.1. For technical support, feature requests, or questions about these terms, please contact us through the app or at our support channels.
12.2. We will make reasonable efforts to respond to support requests in a timely manner.
13.1. These terms are governed by the laws of New Zealand, where Torny Limited is incorporated.
13.2. Any disputes shall be resolved in the courts of New Zealand.
13.3. If any provision is found invalid, the remaining provisions shall continue in effect.
14.1. We may update these terms from time to time to reflect changes in the app or legal requirements.
14.2. Material changes will be communicated through the app or via email to registered users.
14.3. Continued use after changes constitutes acceptance of the updated terms.
